2. Definitions

In these Terms, the following definitions apply:

• "Account" means the personal account created by you on the Platform.
• "Buyer" means a user who purchases Products or Services through the Platform.
• "Platform" means ShopFity's website (shopfity.store), mobile applications, and related services.
• "Product(s)" means any goods listed for sale on the Platform.
• "Seller" means a third-party vendor offering Products or Services through the Platform.
• "Services" means any services offered through the Platform, including vehicle rental, mechanic services, and professional hiring.
• "Voucher" means a credit, discount, or promotional offer provided by ShopFity.
• "User" means any person accessing or using the Platform.

3. General

3.1. The Platform is available only to individuals who are at least 18 years old and capable of forming legally binding contracts.

3.2. You are responsible for ensuring that your use of the Platform complies with all applicable laws in Kenya.

3.3. ShopFity acts as an intermediary between Buyers and Sellers. We are not the seller of any Products unless explicitly stated.

3.4. All transactions are between Buyers and Sellers, with ShopFity facilitating the transaction through our Platform.

3.5. You agree not to use the Platform for any unlawful purpose or in any way that could damage, disable, or impair the Platform.

4. Account

4.1. To access certain features of the Platform, you must create an Account by providing accurate and complete information.

4.2. You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account.

4.3. You must immediately notify ShopFity of any unauthorized use of your Account or any other security breach.

4.4. ShopFity reserves the right to suspend or terminate your Account at our sole discretion if we suspect fraudulent, abusive, or illegal activity.

5. Orders & Financial Terms

5.1. By placing an order through the Platform, you make an offer to purchase the Product(s) or Service(s) from the Seller.

5.2. All orders are subject to acceptance by the Seller. ShopFity will confirm acceptance by sending an order confirmation email.

5.3. Payment must be made at the time of placing the order through one of our approved payment methods:

• M-Pesa
• Cash on Delivery- Limited to Nairobi
• Intasend Checkout
• Paypal

5.4. Prices listed on the Platform are inclusive of VAT where applicable but exclusive of delivery charges, unless otherwise stated.

5.5. ShopFity may cancel any order if:

• The Product is unavailable
• Pricing information is incorrect
• We suspect fraudulent activity
• You fail to meet eligibility criteria

6. Pricing & Availability

6.1. All Products and Services are subject to availability. We do not guarantee that any item listed will be available.

6.2. Prices are subject to change without notice. However, the price charged for an order will be the price in effect at the time the order is placed.

6.3. In the event a Product is mispriced, ShopFity may cancel your order and refund any amounts paid.

6.4. Product descriptions and images are provided by Sellers. While we make reasonable efforts to ensure accuracy, we do not warrant that descriptions or other content are complete, reliable, current, or error-free.

7. Vouchers

7.1. ShopFity may offer Vouchers that can be redeemed against purchases on the Platform.

7.2. Vouchers are subject to specific terms stated at the time of issuance and may have expiration dates.

7.3. Vouchers cannot be exchanged for cash and are non-transferable unless otherwise specified.

7.4. Only one Voucher can be used per order unless otherwise stated.

7.5. ShopFity reserves the right to cancel or modify Voucher promotions at any time without prior notice.

8. Delivery

8.1. Delivery timelines are estimates only and may vary based on:

• Product availability
• Delivery location
• Delivery service selected
• Unforeseen circumstances

8.2. ShopFity offers free delivery for product above KSh 50,000 to most locations in Kenya. For orders below this amount, delivery fees will be displayed at checkout.

8.3. Risk of loss and title for Products pass to you upon delivery to the shipping carrier.

8.4. You must inspect Products upon delivery and report any damage within 24 hours to be eligible for a replacement or refund.

9. Return Policy

9.1. If you are not satisfied with your purchase, you may return eligible Products within 7 days of delivery for a refund or exchange, subject to the following conditions:

• The Product must be unused, in its original packaging, and with all tags attached
• The Product must be in resalable condition
• Proof of purchase must be provided

9.2. The following items are non-returnable:

• Perishable goods
• Refurbished or custom-made items
• Software, DVDs, and other sealed media
• Underwear and personal hygiene products

9.4. Refunds will be processed within 7-14 business days after we receive and inspect the returned item.

10. Privacy

10.1. Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information.

10.2. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.

10.3. We implement security measures to protect your information, but we cannot guarantee absolute security of data transmitted over the internet.

11. Reviews, Comments & Submissions

11.1. Users may post reviews, comments, and other content on the Platform, provided the content is not:

• Illegal, obscene, threatening, defamatory, or invasive of privacy
• Infringing on intellectual property rights
• Commercial solicitation or "spam"
• Containing software viruses or malicious code

11.2. You grant ShopFity a non-exclusive, royalty-free, perpetual, irrevocable right to use, reproduce, modify, and publish any content you submit.

11.3. ShopFity reserves the right to remove or edit any content that violates these Terms.

12. Termination

12.1. Either party may terminate these Terms at any time by providing notice to the other party.

12.2. ShopFity may suspend or terminate your access to the Platform immediately without notice if:

• You breach any provision of these Terms
• We suspect fraudulent or illegal activity
• Required by law or government authority

12.3. Upon termination, your right to use the Platform will immediately cease.

13. Governing Law

13.1. These Terms and any disputes arising out of or related to the Platform shall be governed by and construed in accordance with the laws of Kenya.

13.2. Any legal action or proceeding relating to these Terms shall be instituted in the courts of Kenya.
